St. Louis Lawyers Handling Surgery Error Claims

Surgery is supposed to fix problems, not create new ones. Yet thousands of patients across America suffer preventable injuries each year because surgeons, anesthesiologists, nurses, or other operating room staff make avoidable mistakes.

When you’re unconscious on the operating table, you’re completely vulnerable. You’re trusting an entire team of professionals with your life. Most of the time, that trust is well-placed. But when something goes wrong, when protocols get ignored, when communication breaks down, when fatigue takes over, the consequences can be devastating.

At Missouri Injury Law Firm, our attorneys represent patients and families harmed by surgical mistakes and medical negligence. If you or someone you love suffered injuries during a surgical procedure, contact us for a free consultation to discuss your medical malpractice case.

Types of Surgical Errors and Mistakes

The medical profession has a term for mistakes that should never happen: “never events.” These are errors so preventable and clearly the result of failures in care that they should never occur. According to Johns Hopkins University research, these never events occur at least 4,000 times per year in the United States.

Wrong-Site and Wrong-Patient Surgery

It sounds almost unbelievable that a surgeon could operate on the wrong body part or even the wrong patient entirely, but it happens more often than most people realize. Despite mandatory pre-operative checklists, surgical site markings, and “time-out” protocols designed to prevent exactly these errors, wrong-site surgeries still occur approximately 20 times per week nationwide.

These errors typically stem from:

  • Miscommunication between medical staff during patient transfers
  • Failure to properly verify patient identity before sedation
  • Incorrectly marked surgical sites
  • Confusion when patients have similar names or conditions
  • Skipped or rushed pre-operative verification steps

Retained Foreign Objects

The most common surgical error involves leaving something behind that doesn’t belong there. Surgical sponges are notoriously problematic; they’re used in large quantities during procedures and can be difficult to locate once saturated with blood or tucked into body cavities.

Research published in Surgery found that surgeons leave foreign objects inside patients nearly 40 times per week. These items can include:

  • Surgical sponges and gauze pads
  • Clamps, needles, and other instruments
  • Guidewires and catheters
  • Broken pieces of surgical equipment

Retained foreign bodies often require additional surgery to remove and can cause serious infections, organ perforation, or internal bleeding if not discovered promptly.

Anesthesia Errors

Anesthesia errors carry among the highest consequences of any surgical error. The margin for error is skinny; too much anesthesia can deprive the brain of oxygen, potentially causing permanent damage or death. Too little can result in patients waking during surgery or experiencing pain throughout the procedure.

Common anesthesia errors include:

  • Incorrect dosage calculations
  • Failure to review the patient’s medical history and allergies
  • Improper monitoring during the procedure
  • Equipment malfunction or misuse
  • Delayed response to warning signs

Nerve and Organ Damage

Even when a surgery targets the correct site and proceeds as planned, careless technique can damage surrounding structures. Nerves can be severed or pinched, causing numbness, weakness, or chronic pain. Organs adjacent to the surgical area can be nicked or punctured.

The increasing use of robotic surgery and laparoscopic techniques has, perhaps counterintuitively, increased certain types of complications. While these approaches offer benefits such as smaller incisions, they also reduce tactile feedback and can make it harder for surgeons to detect problems in real time.

Common Causes of Surgical Malpractice

Not every bad outcome constitutes malpractice. Surgery inherently carries risks, and even the most skilled surgeon cannot guarantee perfect results. The question in any surgical error malpractice case is whether the medical team fell below accepted standards of care.

What Leads to Preventable Mistakes?

Several factors contribute to surgical errors:

Contributing Factor

How It Creates Risk

Fatigue

Surgeons working extended shifts may have impaired judgment, slower reflexes, and reduced attention to detail

Miscommunication

Critical patient information gets lost during handoffs between departments or shifts

Inadequate Planning

Insufficient review of imaging, patient history, or procedural requirements before surgery

Time Pressure

Rushed procedures due to scheduling demands or emergencies lead to skipped safety steps

Incompetence

Despite years of training, not all surgeons maintain adequate skills for all procedures

System Failures

Understaffing, equipment problems, or inadequate protocols create conditions where errors flourish

Surgical Procedures Where Errors Occur

While mistakes can happen during any operation, certain types of surgeries see higher rates of complications and malpractice claims:

  • Laparoscopic gallbladder removal
  • Hernia repair
  • Spinal surgery
  • Heart and cardiovascular procedures
  • Bariatric (weight loss) surgery
  • Orthopedic procedures
  • Cesarean sections and obstetric surgeries
  • Emergency room surgeries are performed under time pressure

Proving Your Surgical Error Case

To succeed in a Missouri medical malpractice claim involving surgical errors, you must establish four key elements. This isn’t always straightforward; hospitals and their insurers vigorously defend these cases, and medical records don’t always tell the complete story.

The Four Elements of Medical Malpractice

  1. Duty of Care The surgeon and medical team owed you a professional duty to provide care consistent with accepted medical standards. This is typically established once you become their patient.
  2. Breach of Duty The medical professionals failed to meet those standards. This requires showing what a reasonably competent surgeon with similar training would have done differently in the same circumstances.
  3. Causation The breach directly caused your injury. It’s not enough that an error occurred; you must demonstrate that the mistake, not simply the inherent risks of surgery, led to your harm.
  4. Damages You suffered actual losses as a result, whether medical expenses, lost income, pain and suffering, or other measurable harm.

Missouri’s Affidavit Requirement

Missouri law requires medical malpractice plaintiffs to file an affidavit from a qualified healthcare provider stating that the defendant failed to meet the applicable standard of care. This must be submitted within 90 days of filing your lawsuit. Our medical malpractice attorneys work with qualified experts who can review your records and provide the necessary testimony.

Statute of Limitations

Missouri gives surgical error victims two years from the date of injury to file a malpractice lawsuit. However, there are important exceptions:

  • For retained foreign objects, the clock starts when the object is discovered, not when the surgery occurred
  • For cases involving misdiagnosis or failure to diagnose, the limitation period begins upon discovery
  • Minors have until their 20th birthday to bring claims
  • No case may be filed more than 10 years after the act of malpractice, regardless of when discovered

Given these strict deadlines, contacting an attorney promptly is essential if you suspect surgical negligence.

Compensation for Surgical Error Injuries

Surgical mistakes can transform what should have been a routine recovery into months or years of additional treatment, lost work, and ongoing pain. Patients who successfully prove malpractice may recover damages for all the harm they suffered.

Types of Compensation Available

Medical Expenses: This includes costs for corrective surgeries, extended hospitalization, medications, physical therapy, and any other treatment needed to address the surgical error, both past expenses and anticipated future care.

Lost Income Compensation covers wages lost during extended recovery periods, as well as reduced earning capacity if your injuries prevent you from returning to your previous occupation.

Pain and Suffering:g Physical pain, emotional distress, anxiety, depression, and diminished quality of life resulting from the surgical error.

Wrongful Death Damages. If a loved one died due to surgical negligence, surviving family members may pursue funeral expenses, lost future earnings, and loss of companionship.

Settlement Ranges

Every case is different, and outcomes depend heavily on the specific facts involved. That said, published research suggests average settlement ranges for certain types of surgical errors:

Type of Error

Average Settlement Amount

Wrong procedure performed

$232,035

Wrong-site surgery

$127,159

Surgery on the wrong patient

$109,648

Retained foreign object

$86,247

These figures represent averages and shouldn’t be taken as predictions for any individual case. Severe injuries resulting in permanent disability or death typically result in significantly higher compensation.

Frequently Asked Questions

Not every poor outcome reflects negligence. Surgery carries inherent risks, and sometimes complications occur despite appropriate care. The key distinction is whether your surgeon and medical team met accepted standards of practice. If a reasonably skilled surgeon in similar circumstances would have acted differently and that different action would have prevented your injury, you may have a malpractice claim. Our attorneys can review your case with qualified medical experts to determine whether your injury resulted from substandard care.

Consent forms inform patients about known risks of procedures, but they don’t waive your right to competent care. You consented to the inherent risks of surgery; you didn’t consent to negligence, shortcuts, or preventable errors. If your surgeon failed to follow proper protocols, left instruments inside you, or made careless mistakes, the consent form won’t protect them from liability. Missouri courts consistently hold that informed consent covers expected risks, not substandard care.

Outcomes alone don’t determine malpractice. Many surgeries have uncertain results, and even successful operations don’t always produce the improvements patients hope for. The question isn’t whether you’re disappointed with the results; it’s whether the surgeon’s actions fell below accepted medical standards and directly caused harm. Your attorney will work with medical experts to review operative reports, nursing notes, and imaging studies to determine whether negligence occurred.

Medical malpractice cases are among the most complex personal injury matters. They require extensive review of medical records, consultations with expert witnesses, and, often, depositions of multiple healthcare providers. Most surgical error cases take between 18 months and three years to resolve, though some settle earlier, while others proceed to trial. Missouri’s affidavit requirement adds upfront time but also helps ensure cases have merit before significant resources are invested.

I came to Missouri Injury Law Firm for help with my work comp case. After 1 unsuccessful surgery with a work comp surgeon the insurance company wanted to close my case. I was still in a lot of pain & there was still an obvious problem. With Rob's help, it was determined & proven that the first surgeon missed an issue with my bicep tendon anchor. Before settling my case, Rob was able to get me in for a 2nd surgery. Without Rob's help, the work comp insurance company & case worker would have continued to try & sweep the mistake under the rug. I am very grateful for Rob & the rest of the team at Missouri Injury Law. I would definitely recommend them to anyone with a work comp injury case.

EXTREMELY HAPPY!! Big $$$ incoming!!
We ended up with seriously about 3 times more than I honestly thought we’d get by the end of it! Life changing! The real deal! Not a big giant corporation that cannot remember your name every time you see them! From the moment I walked in to honestly just “shop” around for the right attorney for my situation. I could just feel the connection right away. I am usually a GREAT body and communicative analyzer, I could tell by the end of our first conversation that I’d put my life In his hands. And I did, and he did not disappoint.

I had an intrinsically more difficult case that any lawyer would have had nightmares about! Gene, Taylor, and the crew quite literally make it look like a cake walk! If you trust the process, trust in Gene as he is very professional, not pushy at all, communicative, very compassionate and down to earth! I had no idea what I was in for, being that we had to take the road less traveled on account of my situation.
Gene told me from the start that it would take a 18-36 months to get this done. I took Genes word as Bible. Did exactly as he said when he said it, “tried” not to bother them too much asking for updates (it’s so hard but he does update you if there are things to actually update on right away). Followed the plan step by step and I’m living proof that Gene and the crew will pull the impossible out of their hats given the opportunity! He’s been in this business for a long long time, knows how it works, speaks with such confidence and knowledge, that I will NEVER go anywhere else for my attorney needs. Missouri Injury law firm as a whole was such a great experience for me!!!!! Recommending to everyone I know ! Thank you Gene I owe you a bottle of wine or two !
